According to the websites I saw, it is. However, it may be more nuanced, for example if you are in the prison system already - but in general, the cops can't arrest you for flipping them off.

Hello just:
Nahhh... The Constitution is alive and well even inside a prison. In fact, the Bill of Rights was written FOR citizens who're involved with the police. Inside a prison, your 4th Amendment right to be free from searches, is curtailed among others having to do with security. However, one doesn't lose their right to due process of law, to be free from unusual treatment, and others including the right to free speech. In fact, lots of case law comes from INSIDE prisons, and INSIDE the courtroom, and INSIDE police headquarters.
Now, it's true, your rights are only as good as your ability to enforce them. There are police confrontations where ones rights are respected, and there are confrontations where they are not.. My post is about what the Constitution mandates - NOT how it is enforced..
So, I ask again, is it LEGAL to flip off the cops and/or your jailers??
